Terms and Conditions - Portraits
Named parties
• Client – person or persons purchasing the piece of artwork • Artist – individual supplying the artwork - To Bare My Art and SoulServices Provided
• Commissioned artwork on a subject agreed between the client and artist.Commissioning artwork
• Artwork is not deemed to have been commissioned until both the artist and client have agreed and a deposit has been paid. • Monies are deemed paid when the payment has cleared. • The artist has the right to refuse a commission if the photograph provided is not clear enough for the work to be completed. • Once completed the client will receive a digital proof to approve. If the client does not approve the proof then an explanation of why should be sent to the artist within 48hrs. The artist can then make changes to the artwork as required. • If the client wishes to cancel the order after seeing the proof or due to unforeseen circumstance they can do this by informing the artist in writing. Deposits are non-refundable. • Once the proof has been accepted the client must pay the outstanding balance and postage and packing before the artwork will be released.Delivery
• Artwork can be posted to a client or collected. • When artwork is collected the client needs to provide their own packaging and the artist will not be liable for any damage that occurs to the artwork after collection. • Posted artwork will be by a tracked mail provider. If the artwork arrives damaged the client can either not accept delivery or report the damage, including photographic evidence, to the artist within 24hrs of receipt of the artwork. The artists is not liable for any damage that occurs after the client has accepted delivery or is reported after the 24hr period. • Where artwork has been damaged in transit and the client has acted as per the above then the artist may either offer a replacement piece of work or a full refund to the client. • If the client is outside of the UK then specific terms for delivery to their country will be agreed between the artist and client.Returns and Cancellations
• If the client wishes to cancel the order after receiving the artwork the artist must be notified in writing within 48hrs of receipt. The client will then need to send the artwork back to the artist at their own cost. Upon receipt the artist will refund the cost of the artwork minus the deposit and postage and packing. • If the client wishes to cancel before dispatch of the artwork the deposit is non-refundable and no further monies will be required.Copyright
• Copyright of all website content belongs to the artist. • Full copyright of all art produced remains with the artist, the client may, once fully purchased, display their artwork online or make print copies for their own personal use. • If the artwork is going to be used for commercial purposes then the client will need to contact the artist to arrange a commercial contract. • The artist has the right to display any of their works for marketing/advertising purposes. This could be both online and via printed media. Should the client strongly object to his please notify the artist in writing and the artist will try to accommodate the client where possible. • Any photographs provided to the artist to complete the work belong solely to the client. It is the clients responsibility to ensure that the photographs provide do not infringe any copyright laws, the artist will not be held liable for any infringements made by the client. • Should the artist want to use any of these photographs for marketing or advertising purposes they will obtain the clients agreement to do so.Privacy
